Privacy Policy & Terms and Conditions

 TERMS OF AGREEMENT: Customer understands they are signing a 12 month agreement. Customers are granted the right to cancel this agreement within three (3) days after the date of signing. If Customer cancels this agreement before 12 month term, then Customer agrees to reimburse Breeze Pest Control for the discount received for the initial service, with credit given for the amount already paid. The customer agrees to pay all other charges owed for services already performed. If Customer pays for the service for one year, and then decides to cancel, then Customer is not required to reimburse Breeze Pest Control for the discount received on the initial service. Upon completion of one year term Breeze Pest Control will continue the service until Customer sends to Breeze Pest Control a 30-Day Written Notice to stop the service. After the 12 month term is completed, price is subject to increase due to economic inflation, product price increase, etc. 


SERVICE COMMITMENT: Customer understands and agrees that in order to gain control of the infestation on real property takes time and multiple applications. The initial service is designed as a flushing treatment, which flushes the insects out of their nesting sites. The first quarterly service is designed to break egg cycles and to prevent insects from reproducing and returning to nesting sites. To better control and prevent insect activity requires the customer's cooperation to keep a clean environment, devoid of food and water. Note: Customers are advised to remove personal items, toys, balls, bicycles, tools, barbeques, etc. away from the foundation parameter, and other areas to be treated, before treatments to avoid exposure to these items. Breeze is not responsible for damage, including but not limited to damage arising from carrying out additional contracted or requested services. Covered Target Pests: Ants, Black Widows, Spiders, Oriental Roaches, American Roaches, Fleas (Outdoor), Yellow Jackets, Wasps, Mud Daubers, Silverfish, Earwigs, Crickets, Pill Bugs, Ticks (Outdoor), Mosquito/Fly (Outdoor) Not Covered, But Can Be For Additional Fee(s): Mice and Rats (Indoor), Slugs & Snails, Aphids, German Cockroaches, Gophers, Mosquitos, Squirrels, Mice & Rats (Indoor), Fly Treatment & Traps, Fleas (Interior), Indian Meal Moths, Termite, Bees, Hornets, Bedbugs, Rodent Exclusion, Attic Cleanout WARRANTY: After the Initial application, if the Customer sees an increase in insect activity either inside or outside the house, then Breeze Pest Control will return and perform necessary treatment without additional charge. *limited to treatments included in your paid service plan 


PAYMENT AUTHORIZATION: I authorize Breeze Pest Control to charge the credit card, debit card, or checking account in accordance with the treatment schedule in this agreement. I authorize my bank to debit my account as identified above to the terms stated here. This authorization shall remain in effect until the Service Provider and bank receive written notification from me of intent to terminate at such time and in such manner as to afford the Service Provider and bank reasonable opportunity to act (Minimum 30 days). I understand that if the total amount owed to the Service Provider is increased, I authorize this plan to continue as long as the payment amount remains unchanged until the amount owed the Service Provider is paid off, or unless the plan is terminated earlier by me as above. I understand any added amounts can be applied for with a new ACH Debit Authorization Form. All other changes such as payment amount, frequency, bank account number change, will require a new ACH Debit Payment Authorization Form to be filled out and submitted to Merchant 15 days prior to any change being implemented. I understand that this payment plan may be canceled by the Service Provider or Merchant due to NSF (Non-sufficient Funds). I will be liable to pay an NSF fee of $25.00 (or the amount allowable by law), which may be automatically debited for each NSF. I represent and warrant that I am authorized to execute this payment authorization for the purpose of implementing this payment plan. I indemnify and hold the Service Provider, the bank, and Merchant harmless from damage, loss or claim resulting from all authorized actions hereunder. LIMITATION ON LIABILITY: Customer consents to and understands the IPMP and Breeze is not responsible for the possible poisoning of persons, pets, and/or wildlife as a result of the pest control services performed by Breeze, or as a result of any pest-related bites, stings, or other injury. Breeze is not obligated to repair, replace, or correct any damage to property caused by the pests. 


GENERAL PROVISIONS: 1. Payments are due at time of service and late fees apply after 30 days. In the event Customer shall fail to pay any periodic or installment payment due hereunder, Breeze may cease work without breach pending payment or resolution of dispute. A finance charge of two (2%) percent per month, which is twenty-four (24%) percent per annum (or the maximum sum allowed by law), will be charged on the unpaid balance of past due account. In addition, Customer agrees to pay a collection fee of $75 after default and referral to a collections service company. Further, Customer agrees to pay $2.50 for every statement sent to Customer on past due sums. 2. Breeze Pest shall not be liable for any delay or nonperformance due to circumstances beyond his/her/its control. 3. LAWS. This Agreement shall be construed in accordance with the laws of the state of California. 


ARBITRATION: This Agreement and any controversy or claim arising out of or relating to any part of any provision of this Agreement, or breach thereof, which is not settled to please the parties involved shall be finally adjudicated under the Rules of Binding Arbitration of the American Arbitration Association in Riverside, California, by one Arbitrator appointed in accordance with the said rules; and judgment upon the award rendered by the Arbitrator may be entered in any Court having jurisdiction thereof, including the award to the aggrieved party, its, successors, heirs and/or assigns for all Court costs, reasonable attorneys' fees, and other charges and damages deemed fair by the Arbitrator. 4. This Agreement shall inure to the benefit of the agents, servants, representatives, and assigns. 5. This Agreement constitutes the entire agreement between the Customer and the Breeze, and it supersedes any prior understanding or representation of any kind preceding the date of this Agreement. There are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Agreement. 6. If any part of this Agreement is deemed invalid, illegal or unenforceable, the remaining provisions of the Agreement will remain valid and enforceable as to both parties. Customer Initials: RH I authorize Akela Pest Control to charge my credit/debit account listed above for any and all contracted charges for this service address. 7. In the event that it becomes necessary to enforce any of the terms of this Agreement, the defaulting party agrees to pay all reasonable attorneys' fees and costs incurred therein. 


BUSINESS & PROFESSIONS CODE, SECTION 8538 STATES: "State law requires that you be given the following information: CAUTION--PESTICIDES ARE TOXIC CHEMICALS. Structural Pest Control Companies are registered and regulated by the Structural Pest Control Board, and apply pesticides which are registered and approved for use by the California Department of Pesticide Regulation and the United States Environmental Protection Agency. Registration is granted when the state finds that, based on existing scientific evidence, there are no appreciable risks if proper use conditions are followed or that the risks are outweighed by the benefits. The degree of risk depends upon the degree of exposure, so exposure should be minimized. If within 24 hours following application you experience symptoms similar to common seasonal illness comparable to the flu, contact your physician or poison control center [(800) 876-4766] and your pest control company immediately.
